Driver Assessment and Appeal Division Hearing
There are two ways your driving privileges can be taken away after an OWI arrest if you fail the breath or blood chemical test in Michigan: suspension or revocation.
The main difference between the two is that you still have your driving privileges if your license was suspended—but you can’t use them until your suspension period ends. Once the suspension is over, you will only need to pay a $125 reinstatement fee with the Secretary of State (SOS).
By contrast, you need to schedule a Driver Assessment and Appeal Division (DAAD) hearing with the SOS. Keep in mind, you can only request this hearing once a year. This means if you fail to regain your driving privileges after the initial hearing, you must wait a full year to try again.
In order to succeed, you must prove that you will never drive drunk again and that your substance abuse disorder is permanently under control. You must provide clear convincing evidence—such as a substance abuse evaluation, ten-panel drug screening results, and testimonial letters—to prove your case.
