One of the most common crimes in Michigan is DUI. According to the National Highway Traffic Safety Administration, there are three standardized field sobriety tests used by police.
The walk and turn test examines the driver's ability to walk in a straight line while keeping their balance. Although this may seem simple to accomplish, the divided attention test is difficult for those who are under the influence of alcohol. The one leg stand is another divided attention test which requires the individual to stand on one foot while counting out loud.
The last test is the HNG (horizontal gaze nystagmus) test. There is a naturally occurring jerking in the eye when the gaze goes from side to side, but this jerking is exaggerated when the individual is inebriated. However, one thing is true in all three of these tests: they are not 100% accurate. By allowing a legal professional to examine your case, you could challenge this evidence against you.
